GENERAL TERMS

1. Acceptance of the Terms of Use

This Platform, including the WE LOVE DEALS APP on iOS, Android, and all related websites, is operated by THINA ENTERTAINMENT PRIVATE LIMITED, its subsidiaries, and affiliates (collectively, the “Company," “we," “us," or “our"). The following terms and conditions, together with any documents they expressly incorporate by reference (collectively, these “Terms of Use"), govern your access to and use of the Platform, including any content, functionality, and services offered on or through the Platform, whether as a guest or a registered user.

Please read the Terms of Use carefully before you start to use the Platform. By using the Platform, you accept and agree to be bound and abide by these Terms of Use and our Privacy Policy, incorporated herein by reference. If you do not agree to these Terms of Use or the Privacy Policy, you must not access or use the Platform.

Persons who are under the age of 18 may only use our Platform with legal parental or guardian consent. Accordingly, you agree that you are 18 years of age or older, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, representations, and warranties set forth in these Terms of Use. If not, please exit the Platform. We suggest you take advantage of any access controls offered through the Platform or third-party sites, designed to help you limit or block access to certain types of web content you may feel are harmful to or inappropriate for minors.

You acknowledge that the Platform may include, refer to, or contain content, features, products, or services that make reference to alcohol. Such parts of the Platform (the "Restricted Section") are intended for use only by persons who are of legal age to purchase alcohol in their country of residence and in the country from which they are accessing the Platform. If you do not fall within this category, accessing the Restricted Section may be in breach of the laws or regulations applicable in your country of residence or in the country of access, and you are therefore not permitted to access the Restricted Section.

You expressly acknowledge and agree that any use of the Restricted Section in breach of applicable laws or regulations in your country of residence or in your country of access will be at your sole risk. In no event will THINA ENTERTAINMENT PRIVATE LIMITED, its affiliates, or any of its or their respective licensors or service providers have any liability arising from or related to such use.

2. Changes to the Terms of Use

We may revise and update these Terms of Use from time to time in our sole discretion. All changes are effective immediately upon posting and apply to all access to and use of the Platform thereafter. Your continued use of the Platform following the posting of revised Terms of Use means that you accept and agree to the changes. You are expected to check this page each time you access the Platform to stay informed of any changes, as they are binding on you.

3. App Usage Guidelines and Coupon Redemption Rules

The use of any digital plan or discount coupon made available through the We Love Deals app, operated by THINA ENTERTAINMENT PRIVATE LIMITED, is subject to the following terms, conditions, and limitations. By using the app and its services, you agree to comply with these Terms of Use.

3(a). Fair Use Policy

Use of any plan or coupon is subject to a fair use policy, intended to ensure equitable access for all users. What constitutes fair use shall be determined solely by the respective Vendor, based on the nature of their business and service offerings. The Vendor’s decision in this regard will be final and binding.

3(b). Vendor Availability

Vendor participation may change over time. We do not guarantee that all Vendors will remain available for the entire duration of your plan. Some Vendors may be removed or become temporarily or permanently unavailable without prior notice.

3(c). Coupon Redemption Limitations

A coupon obtained by a single registered user (identified via their mobile number) may be used for one transaction only, subject to the Vendor’s fair use policy.
Coupons are valid for one invoice or bill per redemption. In case of any dispute over what constitutes a single bill, the Vendor’s decision shall prevail.
Coupons may not be used simultaneously by multiple users in a group if, in the Vendor’s opinion, they are part of the same party.
For restaurants, cafes, and similar establishments, coupons are valid only for dine-in orders. They are not applicable for take-away, delivery, or online orders unless expressly stated.

3(d). Booking and Availability

Users are responsible for making advance reservations or checking availability directly with the Vendor to ensure that the coupon can be redeemed on a specific date or time. We are not liable for any unavailability or denial of service by a Vendor.

3(e). Vendor Non-Performance

THINA ENTERTAINMENT PRIVATE LIMITED is not responsible for Vendor non-performance, closures, or unavailability due to maintenance, government regulations, lockdowns, public health directives, private events, or any other reason.

3(f). Coupon-Specific Terms

Some coupons may carry specific terms and conditions determined by the Vendor. These will be visible on the coupon’s redemption screen within the app.
Each coupon has a clearly stated expiry date and is valid only within the period specified.
Coupons can only be used once during the validity of the user's current plan.

3(g). Changes to Plans

Special deals, bonus coupons, or additional Vendors may be introduced during your plan’s validity period. These are optional additions and may not have been included at the time of purchase.
Unused coupons from your current plan will not carry over if you upgrade, downgrade, or repurchase a plan.
Users may purchase a new plan a maximum of two (2) times per year from the date of initial registration. This limit resets annually.

3(h). Buy-One-Get-One Offers

For coupons involving “Buy One, Get One Free,” users must pay for the item of higher or equal value and will receive the second item (of equal or lesser value) at no additional charge, subject to Vendor confirmation.

3(i). Coupon Redemption Process

Coupons must be presented to the Vendor in real time on the user’s registered device with the We Love Deals app installed. Screenshots, printed copies, or forwarded coupons are not accepted under any circumstances.

Some Vendors may accept alternative proof at their discretion, but the default requirement is redemption through the app.

3(j). Authentication and Verification

Vendors reserve the right to verify the authenticity of the app and user. Users must cooperate with Vendors during such verification. If verification cannot be completed, the Vendor may deny redemption of the coupon.

To avoid inconvenience, users are advised to confirm the coupon's acceptance and any applicable conditions with the Vendor in advance.

3(k). No Transfers or Forwarding

Coupons are non-transferable and may not be shared, forwarded, or gifted to other users. Each coupon is strictly limited to the registered user and device.

3(l). Device Limitation

Only one device may be registered per user account. Switching devices may require re-verification.

3(m). Data Sharing with Vendors

User information will only be shared with Vendors with the user's explicit consent, and solely for purposes such as service reviews upon coupon redemption.

3(n). Abuse and Misuse

THINA ENTERTAINMENT PRIVATE LIMITED reserves the right to suspend, deactivate, or permanently bar any user who is found or reasonably suspected to be:

Abusing or misusing the app or coupons,
Attempting to manipulate or bypass the system,
Discrediting the company, app, or associated partners,
Acting in a manner deemed unethical, fraudulent, or harmful to our business.

3(0). Coupon Exclusivity

Coupons may not be used in conjunction with other discounts, promotions, or offers provided by the Vendor, and are not valid for special events unless specifically stated.

4. Accuracy of Information

While we strive to provide up-to-date and accurate information, certain content displayed on the We Love Deals app is subject to change and may not always reflect the latest updates. Accordingly:

Displayed savings are approximate and intended as estimates only. Actual savings may vary at the time of redemption.
Coupon redemption values may be revised by Vendors at any time without prior notice.
Redemption values stated within plans are also subject to change without notice.
Menus, pricing, and Vendor information shown in the app are for general reference purposes only and may not reflect the most recent updates made by the Vendors. Vendors may change their pricing, offerings, or terms at their discretion.

We strongly advise users to verify menu items, pricing, and other relevant details directly with the Vendor prior to using a coupon to avoid any inconvenience, misunderstanding, or disappointment.

5. Accessing the Platform and Account Security

We reserve the right to withdraw or amend the Platform, and any service or material we provide on the Platform, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Platform is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Platform, or the entire Platform, to users, including registered users.

You are responsible for:

Making all arrangements necessary for you to have access to the Platform.
Ensuring that all persons who access the Platform through your internet connection are aware of these Terms of Use and comply with them.

To access the Platform or some of the resources it offers, you may be asked to provide certain registration details or other information. It is a condition of your use of the Platform that all the information you provide on the Platform is correct, current, and complete. You agree that all information you provide to register with the Platform or otherwise, including but not limited to through the use of any interactive features on the Platform, is governed by our Privacy Policy, and you consent to all actions we take with respect to your information consistent with our Privacy Policy.

If you choose, or are provided with, a user name, password, or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any other person or entity. You also acknowledge that your account is personal to you and agree not to provide any other person with access to the Platform or portions of it using your user name, password, or other security information. You agree to notify us immediately of any unauthorised access to or use of your user name or password or any other breach of security. You also agree to ensure that you exit from your account at the end of each session. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information.

We have the right to disable any user name, password, or other identifier, whether chosen by you or provided by us, at any time in our sole discretion for any or no reason, including if, in our opinion, you have violated any provision of these Terms of Use.

6. Intellectual Property Rights

The Platform and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by THINA ENTERTAINMENT PRIVATE LIMITED, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms of Use permit you to use the Platform for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Platform, except as follows:

Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
You may store files that are automatically cached by your web browser for display enhancement purposes.
If we provide desktop, mobile, or other applications for download, you may download a single copy to your computer or mobile device solely for your own personal, non-commercial use, provided you agree to be bound by our end user license agreement for such applications.
If we provide social media features with certain content, you may take such actions as are enabled by such features.

You must not:

Modify copies of any materials from the Platform.
Use any illustrations, photographs, video, or audio sequences, or any graphics separately from the accompanying text.
Delete or alter any copyright, trademark, or other proprietary rights notices from copies of materials from the Platform.
Access or use for any commercial purposes any part of the Platform or any services or materials available through the Platform.

If you wish to make any use of material on the Platform other than that set out in this section, please address your request to info@vod.lk.

If you print, copy, modify, download, or otherwise use or provide any other person with access to any part of the Platform in breach of these Terms of Use, your right to use the Platform will cease immediately and you must, at our option, return or destroy any copies of the materials you have made. No right, title, or interest in or to the Platform or any content on the Platform is transferred to you, and all rights not expressly granted are reserved by THINA ENTERTAINMENT PRIVATE LIMITED. Any use of the Platform not expressly permitted by these Terms of Use is a breach of these Terms of Use and may violate copyright, trademark, and other laws.

7. Trademarks

The name "THINA ENTERTAINMENT PRIVATE LIMITED," its logo, and all related names, logos, product and service names, designs, and slogans are trademarks of THINA ENTERTAINMENT PRIVATE LIMITED or its affiliates or licensors. You must not use such marks without the prior written permission of THINA ENTERTAINMENT PRIVATE LIMITED. All other names, logos, product and service names, designs, and slogans on the Platform are the trademarks of their respective owners.

8. Prohibited Uses

You may use the Platform, including any Restricted Section, only for lawful purposes and in accordance with these Terms of Use. You agree not to use the Platform:

In any way that violates any applicable federal, state, local, or international law or regulation (including, without limitation, any laws regarding the export of data or software).
For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content, asking for personally identifiable information, or otherwise.
To send, knowingly receive, upload, download, use, or re-use any material which does not comply with the Content Standards set out in these Terms of Use.
To transmit, or procure the sending of, any advertising or promotional material without our prior written consent, including any “junk mail," “chain letter," or “spam," or any other similar solicitation.
To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity (including, without limitation, by using e-mail addresses or screen names associated with any of the foregoing).
To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Platform, or which, as determined by us, may harm the Company or users of the Platform or expose them to liability.

Additionally, you agree not to:

Use the Platform in any manner that could disable, overburden, damage, or impair the Platform or interfere with any other party's use of the Platform, including their ability to engage in real-time activities through the Platform.
Use any robot, spider, or other automatic device, process, or means to access the Platform for any purpose, including monitoring or copying any of the material on the Platform.
Use any manual process to monitor or copy any of the material on the Platform or for any other unauthorised purpose without our prior written consent.
Use any device, software, or routine that interferes with the proper working of the Platform.
Introduce any viruses, trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful.
Attempt to gain unauthorised access to, interfere with, damage, or disrupt any parts of the Platform, the server on which the Platform is stored, or any server, computer, or database connected to the Platform.
Attack the Platform via a denial-of-service attack or a distributed denial-of-service attack.
Otherwise attempt to interfere with the proper working of the Platform.

Affiliate Marketing Terms

Affiliate marketers ("Affiliates") promoting the "WE LOVE DEALS APP" Platform must adhere to the following terms, which are designed to ensure compliance with the laws of Sri Lanka and maintain the integrity and reputation of THINA ENTERTAINMENT PRIVATE LIMITED ("the Company").

Compliance with Laws

Affiliates must comply with all applicable laws and regulations of Sri Lanka, including but not limited to:

The Consumer Affairs Authority Act No. 9 of 2003.
The Electronic Transactions Act No. 19 of 2006.
The Intellectual Property Act No. 36 of 2003.
Any other relevant laws governing marketing, advertising, and online business practices.

Promotional Guidelines

Affiliates must adhere to the following guidelines when promoting the Platform:

Honest Representation: All promotional materials must accurately represent the Platform and its offerings. Misleading or false claims are strictly prohibited.
Disclosure Requirements: Affiliates must clearly disclose their relationship with the Company in all marketing communications, in accordance with the guidelines provided by the Consumer Affairs Authority of Sri Lanka.
Content Standards: All content used in promotions must comply with the Content Standards set out in these Terms of Use. This includes not using any defamatory, obscene, or offensive material.

Use of Marketing Materials

Approval of Materials: Affiliates must use only approved marketing materials provided by the Company. Any modifications to these materials must be pre-approved by the Company.
Prohibited Practices: The use of unsolicited commercial emails (spam), misleading domain names, or any other deceptive practices is prohibited.

Brand Integrity

Affiliates must ensure that their promotional activities do not tarnish the reputation or integrity of the Company. This includes:

Respect for Trademarks: Affiliates must not use the Company’s trademarks, logos, or any related branding materials without prior written consent from the Company.
Ethical Marketing: Affiliates must engage in ethical marketing practices and refrain from any conduct that could harm the Company’s reputation.

Prevention of Scams

Affiliates must not use the Platform to scam or deceive people. The "WE LOVE DEALS APP" Platform is not a pyramid scheme. Affiliates are permitted to sell directly to individuals and do not receive income from the activities of downline users. Any attempts to engage in fraudulent activities or create misleading income opportunities are strictly prohibited.

Monitoring and Compliance

Regular Monitoring: The Company reserves the right to monitor all affiliate marketing activities. Affiliates must cooperate with the Company in any compliance investigations.
Termination of Affiliation: The Company reserves the right to terminate the affiliation of any Affiliate who violates these terms or engages in conduct that is detrimental to the Company’s interests.

Liability and Indemnification

Affiliates agree to indemnify and hold harmless the Company, its affiliates, and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to any violation of these Affiliate Marketing Terms or any applicable laws by the Affiliate.

9. User Contributions

The Platform may contain message boards, chat rooms, personal web pages or profiles, forums, bulletin boards, and other interactive features (collectively, “Interactive Services") that allow users to post, submit, publish, display, or transmit to other users or persons (hereinafter, “post") content or materials (collectively, “User Contributions") on or through the Platform.

All User Contributions must comply with the Content Standards set out in these Terms of Use.

Any User Contribution you post to the Platform will be considered non-confidential and non-proprietary. By providing any User Contribution on the Platform, you grant us, our affiliates, and service providers, and each of their and our respective licensees, successors, and assigns the right to use, reproduce, modify, perform, display, distribute, and otherwise disclose to third parties any such material according to your account settings.

You represent and warrant that:

You own or control all rights in and to the User Contributions and have the right to grant the license granted above to us, our affiliates, and service providers, and each of their and our respective licensees, successors, and assigns.
All of your User Contributions do and will comply with these Terms of Use.

You understand and acknowledge that you are responsible for any User Contributions you submit or contribute, and you, not THINA ENTERTAINMENT PRIVATE LIMITED, have full responsibility for such content, including its legality, reliability, accuracy, and appropriateness.

We are not responsible or liable to any third party for the content or accuracy of any User Contributions posted by you or any other user of the Platform.

10. Monitoring and Enforcement; Termination

We have the right to:

Remove or refuse to post any User Contributions for any or no reason in our sole discretion.
Take any action with respect to any User Contribution that we deem necessary or appropriate in our sole discretion, including if we believe that such User Contribution violates the Terms of Use, including the Content Standards, infringes any intellectual property right or other right of any person or entity, threatens the personal safety of users of the Platform or the public, or could create liability for the Company.
Disclose your identity or other information about you to any third party who claims that material posted by you violates their rights, including their intellectual property rights or their right to privacy.
Take appropriate legal action, including without limitation, referral to law enforcement, for any illegal or unauthorised use of the Platform.
Terminate or suspend your access to all or part of the Platform for any or no reason, including without limitation, any violation of these Terms of Use.

Without limiting the foregoing, we have the right to fully cooperate with any law enforcement authorities or court orders requesting or directing us to disclose the identity or other information of anyone posting any materials on or through the Platform. YOU WAIVE AND HOLD HARMLESS THINA ENTERTAINMENT PRIVATE LIMITED AND ITS AFFILIATES, LICENSEES, AND SERVICE PROVIDERS FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY ANY OF THE FOREGOING PARTIES DURING OR AS A RESULT OF ITS INVESTIGATIONS AND FROM ANY ACTIONS TAKEN AS A CONSEQUENCE OF INVESTIGATIONS BY SUCH PARTIES OR LAW ENFORCEMENT AUTHORITIES.

However, we do not undertake to review material before it is posted on the Platform, and cannot ensure prompt removal of objectionable material after it has been posted. Accordingly, we assume no liability for any action or inaction regarding transmissions, communications, or content provided by any user or third party. We have no liability or responsibility to anyone for performance or nonperformance of the activities described in this section.

11. Content Standards

These content standards apply to any and all User Contributions and use of Interactive Services. User Contributions must in their entirety comply with all applicable federal, state, local, and international laws and regulations. Without limiting the foregoing, User Contributions must not:

Contain any material which is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable.
Promote sexually explicit or pornographic material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.
Infringe any patent, trademark, trade secret, copyright, or other intellectual property or other rights of any other person.
Violate the legal rights (including the rights of publicity and privacy) of others or contain any material that could give rise to any civil or criminal liability under applicable laws or regulations or that otherwise may be in conflict with these Terms of Use or our Privacy Policy.
Be likely to deceive any person.
Promote any illegal activity, or advocate, promote, or assist any unlawful act.
Cause annoyance, inconvenience, or needless anxiety or be likely to upset, embarrass, alarm, or annoy any other person.
Impersonate any person, or misrepresent your identity or affiliation with any person or organization.
Involve commercial activities or sales, such as contests, sweepstakes, and other sales promotions, barter, or advertising.
Give the impression that they emanate from or are endorsed by us or any other person or entity, if this is not the case.

12. Copyright Infringement

If you believe that any User Contributions violate your copyright, please send us a notice of copyright infringement to info@vod.lk. It is the policy of THINA ENTERTAINMENT PRIVATE LIMITED to terminate the user accounts of repeat infringers.

13. Reliance on Information Posted

The information presented on or through the Platform is made available solely for general information purposes. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to the Platform, or by anyone who may be informed of any of its contents.

The Platform may include content provided by third parties, including materials provided by other users. All statements and/or opinions expressed in these materials, and all articles and responses to questions and other content, other than the content provided by THINA ENTERTAINMENT PRIVATE LIMITED, are solely the opinions and the responsibility of the person or entity providing those materials. These materials do not necessarily reflect the opinion of THINA ENTERTAINMENT PRIVATE LIMITED. We are not responsible, or liable to you or any third party, for the content or accuracy of any materials provided by any third parties.

14. Changes to the Website

We may update the content on the Platform from time to time, but its content is not necessarily complete or up-to-date. Any of the material on the Platform may be out of date at any given time, and we are under no obligation to update such material.

15. Information About You and Your Visits to the Website

All information we collect on the Platform is subject to our Privacy Policy. By using the Platform, you consent to all actions taken by us with respect to your information in compliance with the Privacy Policy.

16. Online Purchases and Other Terms and Conditions

All purchases through our Platform or other transactions for the sale of goods or services formed through the Platform or as a result of visits made by you are governed by our Terms of Sale, which are hereby incorporated into these Terms of Use.

Additional terms and conditions may also apply to specific portions, services, or features of the Platform. All such additional terms and conditions are hereby incorporated by this reference into these Terms of Use.

16(a) Refund Policy

You may request a refund for your app purchase within three (3) days of the original transaction date, provided that no coupon or promotional offer has been redeemed. Refund requests must be submitted via:

Refunds are only applicable to Local packages. Tourist packages are final and non-refundable.

If the purchase was made using an affiliate link, and the affiliate commission has already been paid prior to the refund request, the amount paid to the affiliate will be deducted from your eligible refund.

This policy does not limit or exclude any rights you may have under applicable consumer protection laws.

17. Linking to the Website and Social Media Features

You may link to our homepage, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval, or endorsement on our part without our express written consent.

The Platform may provide certain social media features that enable you to:

Link from your own or certain third-party websites to certain content on the Platform.
Send emails or other communications with certain content, or links to certain content, on the Platform.
Cause limited portions of content on the Platform to be displayed or appear to be displayed on your own or certain third-party websites.

You may use these features solely as they are provided by us and solely with respect to the content they are displayed with and otherwise in accordance with any additional terms and conditions we provide with respect to such features. Subject to the foregoing, you must not:

Establish a link from any website that is not owned by you.
Cause the Platform or portions of it to be displayed, or appear to be displayed by, for example, framing, deep linking, or in-line linking, on any other website.
Link to any part of the Platform other than the homepage.
Otherwise take any action with respect to the materials on the Platform that is inconsistent with any other provision of these Terms of Use.

The website from which you are linking, or on which you make certain content accessible, must comply in all respects with the Content Standards set out in these Terms of Use.

You agree to cooperate with us in causing any unauthorised framing or linking to cease immediately. We reserve the right to withdraw linking permission without notice.

We may disable all or any social media features and any links at any time without notice at our discretion.

18. Links from the Website

If the Platform contains links to other sites and resources provided by third parties, these links are provided for your convenience only. This includes links contained in advertisements, including banner advertisements and sponsored links. We have no control over the contents of those sites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them. If you decide to access any of the third-party websites linked to the Platform, you do so entirely at your own risk and subject to the terms and conditions of use for such websites.

19. Geographic Restrictions

Access to the Platform may not be legal in certain countries. If you access the Platform in such cases, you do so on your own initiative and are responsible for compliance with the relevant local laws.

20. Disclaimer of Warranties

You understand that we cannot and do not guarantee or warrant that files available for downloading from the internet or the Platform will be free of viruses or other destructive code. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for anti-virus protection and accuracy of data input and output, and for maintaining a means external to our Platform for any reconstruction of any lost data. WE WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE CAUSED BY A DISTRIBUTED DENIAL-OF-SERVICE ATTACK, VIRUSES, OR OTHER TECHNOLOGICALLY HARMFUL MATERIAL THAT MAY INFECT YOUR COMPUTER EQUIPMENT, COMPUTER PROGRAMS, DATA, OR OTHER PROPRIETARY MATERIAL DUE TO YOUR USE OF THE PLATFORM OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE PLATFORM OR TO YOUR DOWNLOADING OF ANY MATERIAL POSTED ON IT, OR ON ANY WEBSITE LINKED TO IT.

YOUR USE OF THE PLATFORM, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE PLATFORM IS AT YOUR OWN RISK. THE PLATFORM, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE PLATFORM ARE PROVIDED ON AN “AS IS" AND “AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER THINA ENTERTAINMENT PRIVATE LIMITED NOR ANY PERSON ASSOCIATED WITH THINA ENTERTAINMENT PRIVATE LIMITED MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE PLATFORM. WITHOUT LIMITING THE FOREGOING, NEITHER THINA ENTERTAINMENT PRIVATE LIMITED NOR ANYONE ASSOCIATED WITH THINA ENTERTAINMENT PRIVATE LIMITED REPRESENTS OR WARRANTS THAT THE PLATFORM, ITS CONTENT, OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE PLATFORM WILL BE ACCURATE, RELIABLE, ERROR-FREE OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT OUR PLATFORM OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS OR THAT THE PLATFORM OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE PLATFORM WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.

THINA ENTERTAINMENT PRIVATE LIMITED HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.

THE FOREGOING DOES NOT AFFECT ANY WARRANTIES WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

21. Limitation of Liability

Vendor Responsibility

THINA ENTERTAINMENT PRIVATE LIMITED provides access to coupons through the We Love Deals app but is not responsible for the quality, quantity, service, or experience provided by any participating Vendor. All products, services, and experiences are delivered solely by the Vendor, and any issues must be resolved directly between the User and the Vendor.

Indemnification

By using the app, you agree to indemnify and hold harmless THINA ENTERTAINMENT PRIVATE LIMITED from any claims, complaints, or disputes arising from the actions, omissions, or service standards of any Vendor.

Emotional or Consequential Damages

We are not liable for emotional distress, loss of opportunity, inconvenience, embarrassment, or any direct or indirect damages resulting from the use of coupons or dissatisfaction with a Vendor experience.

Monetary Transactions

Except for payments made to purchase a user plan via the We Love Deals app, all financial transactions occur directly between you and the Vendor. Unless expressly stated in writing, THINA ENTERTAINMENT PRIVATE LIMITED does not act as a financial intermediary or handle payments on behalf of Vendors.

Vendor Availability and Coupon Validity

While we make every effort to encourage Vendors to honor coupons in good faith, Vendors may withdraw or be removed from the app without notice. In such cases, we are under no obligation to offer replacements, compensation, or alternate deals.

Health and Safety Standards

We are not responsible for the health, safety, hygiene, or legal compliance of any Vendor. Vendors are solely accountable for maintaining required standards and safeguards. We disclaim all liability for harm, injury, or damage arising from Vendor negligence or failure to comply with applicable standards.

Fair Use Enforcement

Decisions related to fair use of coupons—including disallowing or disbarring a user for misuse—are at the sole discretion of THINA ENTERTAINMENT PRIVATE LIMITED and do not give rise to liability.

Service Interruptions

We are not liable for any downtime, accessibility issues, or technical failures of the We Love Deals app, including but not limited to crashes, server outages, or unavailability.

Limitation of Liability

In any event, the maximum liability of THINA ENTERTAINMENT PRIVATE LIMITED to any user for any claim related to use of the app or a purchased plan shall not exceed the amount paid for that specific plan.

21(a). Limitation on Liability

IN NO EVENT WILL THINA ENTERTAINMENT PRIVATE LIMITED, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE PLATFORM, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE PLATFORM OR SUCH OTHER WEBSITES OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE PLATFORM OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, EVEN IF FORESEEABLE.

THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

22. Indemnification

You agree to defend, indemnify, and hold harmless THINA ENTERTAINMENT PRIVATE LIMITED, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Use or your use of the Platform, including, but not limited to, your User Contributions, any use of the Platform's content, services, and products other than as expressly authorised in these Terms of Use, or your use of any information obtained from the Platform.

23. Governing Law and Jurisdiction

All matters relating to the Platform and these Terms of Use and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of Sri Lanka, without giving effect to any choice or conflict of law provision or rule (whether in Sri Lankan or any other jurisdiction).

Any legal suit, action, or proceeding arising out of, or related to, these Terms of Use or the Platform shall be instituted exclusively in the courts of Sri Lanka, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms of Use in your jurisdiction of residence or any other relevant jurisdiction. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

24. Limitation on Time to File Claims

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OF USE OR THE PLATFORM MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES, OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.

25. Waiver and Severability

No waiver by THINA ENTERTAINMENT PRIVATE LIMITED of any term or condition set forth in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of THINA ENTERTAINMENT PRIVATE LIMITED to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

26. Entire Agreement

These Terms of Use, along with our End User License Agreement, Rules of Use, Privacy Policy, and Terms of Sale, constitute the sole and entire agreement between you and THINA ENTERTAINMENT PRIVATE LIMITED with respect to the Platform and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to the Platform.
